This Privacy Policy explains how your personal information is collected, used, and disclosed when you visit our website, contact us about an event, book our services, or attend an event where our equipment is in use.
This Privacy Policy applies to www.snapandswing.com and its associated subdomains (collectively, our "Service"), to our booking, quoting, and messaging tools, and to the photo, video, and game equipment we rent and staff at events. By accessing or using our Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms & Conditions.

To help explain things as clearly as possible in this Privacy Policy, each time any of these terms is referenced, it is strictly defined as:

IP address: every device connected to the internet is assigned a number known as an Internet Protocol (IP) address. These numbers are usually assigned in geographic blocks. An IP address can often be used to identify the general location from which a device is connecting to the internet.

Personal Data: any information that directly, indirectly, or in connection with other information — including a personal identification number — allows for the identification or identifiability of a natural person.

Personnel: those individuals who are employed by Snap & Swing LLC or who are under contract to perform a service on our behalf, including event attendants and subcontracted staff.

What Information Do We Collect?
We collect information from you when you visit our website, submit an inquiry or quote request, book an event, sign a contract, make a payment, opt in to text messages, subscribe to our email list, respond to a survey, leave a review, or use our equipment at an event.

Photos, Video, and Event Media
Our core service captures images of people. We treat that content with care, and this section explains how it works.

Delivery to guests. When an Event Guest chooses to send their Event Media to themselves, we use the mobile number or email address they enter for that delivery and for nothing else. We do not add booth-entered contact details to our marketing lists unless the guest separately and affirmatively opts in on screen.

Delivery to the Client. Event Media captured at an event is delivered to the Client through a private online gallery or file transfer. The Client controls who they share that gallery with. Once the Client redistributes Event Media, that redistribution is outside our control and is governed by the Client’s own choices.

Retention of galleries. Online galleries are typically available for ninety (90) days after an event unless a longer term is stated in the event contract. We retain a working archive of Event Media for up to twelve (12) months after the event so that we can service reprint, re-delivery, and dispute requests, after which it is deleted from active systems.

Marketing use. We may use a limited selection of Event Media in our portfolio, website, social media, and advertising only where the Client has granted us that right in the signed event contract. If you appear in Event Media and do not want it used in our marketing, contact us and we will remove it from our marketing channels.

No facial recognition. We do not use facial recognition, faceprints, or other biometric identification technology, and we do not sell, license, or otherwise provide Event Media to any third party for the training of artificial intelligence or machine learning systems.

Public event settings. Where our equipment is used at a public or community event, guests are photographed only when they choose to step into or in front of the equipment. Signage at the activation notifies guests that photos are being taken.
Text Messaging (SMS/MMS)
Snap & Swing may send text messages for booking coordination, event day logistics, invoice and payment reminders, delivery of Event Media, and — where you have separately opted in — occasional promotional offers.

Consent. We send text messages only to mobile numbers that have been provided to us with consent, either through a web form, a signed contract, an on-screen booth prompt, or by texting us first. Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies based on your event and your interactions with us.

Rates. Message and data rates may apply.

Opting out. You may cancel at any time by replying STOP to any message from us. After you reply STOP, we will send one confirmation message and will not send further text messages unless you opt back in.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
How Do We Use the Information We Collect?
Any of the information we collect from you may be used in one or more of the following ways:

When Do We Use Information From Third Parties?
We receive some information about you from third parties. For example, when you submit an inquiry through a lead platform, a wedding or event directory, a venue referral, or a social media message, that platform passes your contact details and event details to us. We also receive limited transaction information from our payment processors, and we occasionally collect information that has been made publicly available on social media. You can control how much of your information social media websites make public by visiting those websites and changing your privacy settings.
Where a venue, planner, or corporate client books us on your behalf, we receive your contact and event information from them and use it solely to deliver the booked services.
Do We Share the Information We Collect With Third Parties?
We do not sell your personal information, and we do not share your personal information with advertisers, affiliates, or other third parties for their own marketing or promotional purposes.
We do share information in the following limited circumstances:

Service providers. We engage trusted third-party service providers to perform functions on our behalf, such as website hosting and maintenance, online galleries and file delivery, customer relationship and booking management, email and text message delivery, bookkeeping, insurance, and payment processing. We share only the information these providers need to perform their services for us and for you, and they are required to protect it.

Venues, planners, and co-vendors. Where necessary to deliver your event, we share operational details such as your name, event date, arrival window, and equipment footprint with the venue, planner, coordinator, or other vendors working the same event.

Event staff. Our attendants and any subcontracted staff receive the event details necessary to set up and run your activation.

Analytics. We may share portions of our log file data, including IP addresses, with web analytics providers. If your IP address is shared, it may be used to estimate general location and other technical details such as connection speed and the type of device used to visit the website.

Business transfers. If we are involved in a merger, asset sale, financing, or other business reorganization, we may transfer your personal and non-personal information to our successor-in-interest, provided that the successor agrees to adhere to the terms of this Privacy Policy.

Legal. We may disclose information about you to government or law enforcement officials or private parties where we, in our sole discretion, believe it necessary or appropriate to respond to claims or legal process, to protect our rights and interests or those of a third party, to protect the safety of the public or any person, to prevent or stop any illegal or legally actionable activity, or to otherwise comply with applicable court orders, laws, rules, and regulations.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
How Do We Use Your Email Address?
By submitting your email address on this website or in a booking form, you agree to receive emails from us relating to your inquiry, quote, contract, event, and account. You can cancel your participation in any of our marketing email lists at any time by clicking the unsubscribe link included in the respective email. We only send marketing emails to people who have authorized us to contact them. We do not send unsolicited commercial email. Email addresses submitted solely through a checkout or order page are used only to send you information and updates pertaining to that order. If you have provided the same email address to us through another method, we may use it for the purposes stated in this Policy.
Note that transactional messages relating to an active booking — such as invoices, contracts, schedule changes, and gallery delivery — are not marketing messages, and you will continue to receive them while your booking is active even if you unsubscribe from marketing email.
How Long Do We Keep Your Information?
We keep your information only so long as we need it to provide our services to you and to fulfill the purposes described in this policy. This is also the case for anyone we share your information with who carries out services on our behalf.

Inquiries that do not convert to a booking: up to twenty-four (24) months.

Event Media galleries: typically ninety (90) days of active availability; working archive up to twelve (12) months after the event unless the event contract states otherwise.

Booth-entered guest contact details used only for delivery: deleted within ninety (90) days of the event.

Contracts, invoices, and financial records: retained as required by applicable tax, accounting, and statute of limitations rules, generally seven (7) years.

Text messaging opt-in records: retained for as long as you remain opted in, and afterward as needed to evidence consent and honor your opt-out.
When we no longer need to use your information and there is no need to keep it to comply with our legal or regulatory obligations, we will either remove it from our systems or de-identify it so that we cannot identify you.
How Do We Protect Your Information?
We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. Our website is served over a secure connection, and sensitive payment information is transmitted using Secure Socket Layer (SSL) technology directly to our payment gateway providers, accessible only by those authorized with special access rights to those systems and required to keep the information confidential. After a transaction, full card numbers are never kept on file by us. Company accounts are protected with strong, unique credentials and multi-factor authentication where available, and equipment used to capture Event Media is kept in our custody or the custody of our staff while in transit and on site.
We cannot, however, ensure or warrant the absolute security of any information you transmit to Snap & Swing LLC or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards. Neither people nor security systems are foolproof, including encryption systems, and people can commit intentional crimes, make mistakes, or fail to follow policies. While we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.
Could My Information Be Transferred to Other Countries?
Snap & Swing LLC is organized in the State of Utah, United States, and provides services in Utah. Information collected via our website, through direct interactions with you, or through our support channels may be stored or processed by service providers located in other jurisdictions, and may be viewed and hosted outside your state or country, including in countries that may not have laws of general applicability regulating the use and transfer of such data. To the fullest extent allowed by applicable law, by using the Service you voluntarily consent to the trans-border transfer and hosting of such information.
Can I Update or Correct My Information?
The rights you have to request updates or corrections to the information Snap & Swing LLC collects depend on your relationship with us. Personnel may update or correct their information as detailed in our internal employment policies.
Clients and Event Guests may contact us in order to (1) update or correct personally identifiable information, (2) change preferences with respect to communications and other information received from us, or (3) request deletion of the personally identifiable information maintained about them on our systems. Such updates, corrections, changes, and deletions will have no effect on other information that we maintain, or on information we have already provided to third parties in accordance with this Privacy Policy prior to the request. To protect your privacy and security, we may take reasonable steps to verify your identity before granting access or making corrections.
You should be aware that it is not technologically possible to remove every record of the information you have provided from our systems. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form. Promptly after receiving your request, all personal information stored in databases we actively use and other readily searchable media will be updated, corrected, changed, or deleted as appropriate, as soon as and to the extent reasonably and technically practicable.
If you attended an event as a guest and wish to update, delete, or receive information we hold about you, you may contact us directly using the details at the end of this policy, or contact the Client who hosted the event.
Sale of Business
We reserve the right to transfer information to a third party in the event of a sale, merger, or other transfer of all or substantially all of the assets of Snap & Swing LLC or any of its Corporate Affiliates, or that portion of the business to which the Service relates, or in the event that we discontinue our business or file, or have filed against us, a petition in bankruptcy, reorganization, or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.
Affiliates
We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity that directly or indirectly controls, is controlled by, or is under common control with Snap & Swing LLC, whether by ownership or otherwise. Snap & Swing LLC is a wholly owned subsidiary of Ulara LLC, a Utah limited liability company. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Privacy Policy, and mobile information and text messaging opt-in data are excluded from any such disclosure for marketing or promotional purposes.
Governing Law
This Privacy Policy is governed by the laws of the State of Utah without regard to its conflict of laws provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Weber County, Utah in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy. Your use of the website may also be subject to other local, state, national, or international laws.
By using our Service or contacting us directly, you signify your acceptance of this Privacy Policy. We are not responsible for the content, accuracy, or opinions expressed on such websites, and such websites are not investigated, monitored, or checked for accuracy or completeness by us. When you use a link to go from the Service to another website, this Privacy Policy is no longer in effect. Your browsing and interaction on any other website is subject to that website’s own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.

Remarketing Services
We use remarketing services. In digital marketing, remarketing (or retargeting) is the practice of serving ads across the internet to people who have already visited a website. It allows us to display ads on the websites and platforms our past visitors use most. We do not use booth-entered guest contact details or text messaging opt-in data for remarketing.
Children’s Privacy
Our website and our booking services are directed to adults and are not intended for children. We do not knowingly collect personal information online from children under the age of 13. If you are a parent or guardian and you become aware that your child has provided us with personal data without your permission, please contact us. If we become aware that we have collected personal data online from anyone under the age of 13 without verification of parental consent, we will take steps to remove that information from our systems.
Because we operate photo equipment at weddings, corporate functions, and community events, children may appear in Event Media when a parent, guardian, or host allows them to use the equipment. Event Media in which minors appear is delivered to the Client and is not used in our marketing without the express permission of a parent or guardian. If your child appears in Event Media that you would like removed from our marketing channels, contact us and we will remove it.
Utah Residents
Snap & Swing LLC is a Utah business. As a matter of practice, and regardless of whether the Utah Consumer Privacy Act applies to a business of our size, Utah residents may contact us to request access to the personal data we hold about them, to request deletion of that personal data, to obtain a copy of the personal data they previously provided to us, and to opt out of the processing of their personal data for targeted advertising. We do not sell personal data, and we do not process sensitive data for profiling purposes. We will not discriminate against you for exercising these rights.
California Residents
The California Consumer Privacy Act (CCPA) requires us to disclose the categories of personal information we collect and how we use it, the categories of sources from which we collect personal information, and the third parties with whom we share it, which we have explained above.
